1. Sponsorship. Hocking Hills Weekend Getaway (the “Sweepstakes”) is sponsored by Andy Norris REALTOR® with The One Group of Keller Williams Greater Columbus with a principal address of 1 Easton Oval, Columbus, OH 43219, Bridge Title & Escrow, LLC with a principal address of 110 Polaris Pkwy #225, Westerville, OH 43082, and Sights Unseen Travel with a principal address of 562 Meadow Ln, Marion, OH 43302 (“Sponsor” and “Sponsor’s Location”). The Sweepstakes is governed by these Official Rules. By participating in the Sweepstakes, you agree to be bound by these Official Rules and the decisions of the Sponsor (including Sponsor’s interpretation and application of these Official Rules), which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules in a timely manner.2. Eligibility. The Sweepstakes is open to all natural persons who are (a) residents of the State of Ohio and (b) at the time of entry, at least twenty-one (21) years of age. As applicable, officers of the Sponsor, employees of the Sponsor, their affiliates, franchisee, licensees, advertising and promotional agencies, as well as the spouse and children of each, are ineligible to participate in this Sweepstakes. Entries submitted by or on behalf of entrants who do not meet the eligibility requirements are void.3. Sweepstakes Procedure. The Sweepstakes will begin on Friday, October 21, 2022 at 10:00AM ET and end on Friday, October 21, 2022 at 6:00PM ET, unless earlier terminated or canceled by Sponsor (the “Entry Period”). During the Entry Period, Participants may enter by (a) calling Andy Norris (“Agent”) on his company telephone and (b) providing that Agent with Participant’s (i) first and last name, (ii) address, (iii) telephone number and (iv) email address. Calls to the Agent will be accepted on a first-come, first-served basis. Sponsor is not responsible for any calls that are unexpectedly dropped or disrupted prior to an entry being fully completed or for any entries not completed because of any disruption in telephone service. Participants may, but are not required, to provide the Agent with additional information including answering questions concerning the participant’s recent real estate activity or anticipated future real estate needs, if any. Each person that calls each Agent during the Entry Period is referred to herein as a “Participant”. One entry per person during the Entry Period. Use of any automated system to participate is prohibited and will result in disqualification. Entries that are incomplete, late, misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes, at the Sponsor’s sole and absolute discretion. Attempts made by the same individual to submit multiple entries by using multiple names, emails, telephone numbers, or other means may be disqualified. Entries generated by any automated means are void and may be disqualified. The Sponsor’s clock will be the official timekeeper for the receipt of all entries into the Sweepstakes.4. NO PURCHASE IS NECESSARY TO ENTER OR WIN THE SWEEPSTAKES. A PURCHASE WILL NOT IMPROVE A PARTICIPANT’S CHANCES OF WINNING A PRIZE IN THE SWEEPSTAKES.5. Drawings. The potential winner will be selected by a random drawing from all eligible entries received in accordance with these Official Rules during the Entry Period (the “Drawing”). The Drawing will be conducted by a representative of Sponsor, or by a third party administrator at Sponsor’s direction. The potential winner will be selected on Friday, October 21, 2022, sometime after 6:00 PM EST (the “Drawing Date”).6. Announcement of Winners. If you are a potential winner you will be notified by the Sponsor within forty-eight (48) hours following the Drawing Date via the email and telephone number provided to the Agent at the time of entry (the “Announcement Correspondence”). Sponsor will include information on contacting Sponsor to claim the Prize in the Announcement Correspondence.To claim a prize, the potential winner must reply to the Sponsor within forty-eight (48) hours of the Announcement Correspondence, or as otherwise directed in the notification. If the potential winner does not respond to the Sponsor’s prize notification email or phone call within forty-eight (48) hours of the Announcement Correspondence or if the notification is rejected, faulty, unclaimed or returned undeliverable (for any reason whatsoever) to such potential winner, the potential winner may be deemed to have forfeited the Prize, and the Sponsor will have the sole and absolute discretion to select, by random drawing, another potential winner from the remaining eligible entries.7. Prizes, Prize Values, Odds of Winning and Collecting Prizes.(a) By entering this promotion, Participant is eligible to win a cash prize in the amount of Six Hundred Dollars ($600) and access to a travel agent at Sights Unseen Travel (the “Prize”). A Prize may not be transferred and must be accepted as awarded. A winner may not request a substitute prize. A winner is not required to use the suggested travel agent. Sponsor reserves the right to substitute the Prize with another prize of equal of greater value if the Prize is not available for any reason, as determined by Sponsor in its sole discretion. It is the Participant’s responsibility to read and understand all information, if any, which accompanies any Prize concerning use, risks, and maintenance.(b) All costs and expenses associated with a Participant’s acceptance and use of a Prize not specified herein as being provided as part of the Prize are the sole responsibility of the winning Participant.(c) A winning Participant is solely responsible for reporting and paying all applicable federal, state, and local taxes related to the Prize. No responsibility or liability is assumed for any obligations, damages, losses or injury resulting from acceptance or use of the Prize or any substitute therefore. Following the winner claiming the Prize, the failure to utilize the Prize does not relieve the winner of tax obligations associated with receiving the Prize. For the Prize, the United States of America Internal Revenue Service (IRS) requires Form 1099-MISC for U.S. residents to be issued and filed, for each winner who receives a Prize if the amount of the Prize is $600 or more. Sponsor will send the winner a Form W-9, which must be completed and returned to Sponsor for the winner to receive the Prize. A copy of the Form 1099-MISC filed by Sponsor will be sent to the winner. The Form 1099-MISC will be issued for the fair market value of the Prize. Any winner who fails to promptly (i.e., within ten (10) business days) provide information sufficient to complete the Form 1099-MISC including, without limitation, their legal name, address, and social security number, shall forfeit any and all rights to the Prize.(d) The odds of winning are dependent entirely on the number of entries received during the applicable Entry Period for the Drawing.(e) The approximate retail value of the Prize is $600 (United States Dollars).(f) Before being awarded a prize, winner will be required to provide Sponsor proof of identification and other proof of eligibility under these Official Rules and execute and return documentation such as an affidavit of eligibility, a publicity release, a release of liability, a tax acknowledgment form, and other documents, each within the period of time specified by the Sponsor.(g) All travel that Participant may elect to take is subject to any and all advisories, restrictions or requirements instituted by the local governance, as required. Participant understands that (i) the SARS-CoV-2 and any resulting disease (together with any mutation, adaption or variation thereof, “COVID-19”) is contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (ii) no precautions, including the protocols that may be implemented from time to time based upon public health and government-sponsored guidelines can eliminate the risk of exposure to COVID-19; and (iii) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition. Except as set forth herein, unforeseen or changed circumstances impacting a Participant’s ability or availability to carry out the requirements necessary to redeem the Prize will result in disqualification. Released Parties (as defined herein) have not arranged and do not carry any insurance of any kind for Participant’s benefit. Participants will be solely responsible for obtaining and paying for any medical, life, accident or other insurance relative to their acceptance and use of the Prize. No refund or compensation will be made in the event of the cancellation or delay of any flight, connection or transfer in connection with Participant’s use of the Prize.8. Release & Indemnity. To the fullest extent permitted by law, Participants forever release, discharge, and covenant not to sue Sponsor, affiliates, owners, employees, agents, directors, officers, shareholders, contractors, successors and assigns (collectively “Released Parties”) for, from and against, any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions, causes of action whatsoever, of every nature, character and description (collectively, “Claims”), known and unknown, arising out of or in any way related to the Sweepstakes, these Official Rules, the negligence of any of the Released Parties, entry into the Sweepstakes and the acceptance, possession, misuse or use of any Prize. By participating in the Sweepstakes, each Participant also agrees to indemnify, defend, release, discharge and hold harmless Released Parties from any and all Claims of any kind whatsoever for injuries, death, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use or misuse of any Prize by Participant and Participant’s guests and invitees, including without limitation, claims for breach of contract, infliction of emotional distress, defamation, false light, common law or statutory misappropriation, invasion or other violations of any actual or purported right of privacy and/or publicity, and claims under equivalent federal, state or provincial laws arising from participation and any exploitation of any or all of the rights granted to Sponsor. In addition, each Participant acknowledges and agrees that the Released Parties are not responsible for any costs, injuries, losses, or damages of any kind arising from or in connection with: (i) late, lost, delayed, disrupted, misdirected, incomplete, or otherwise deficient entries; (ii) any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or discontinued; (iii) any failure to receive or process entries due to any cause, including without limitation, human, transmission or technical problems, failures, or malfunctions of any kind, howsoever originating, that may limit an participant’s ability to participate in the sweepstakes including any interruptions to any network, server, Internet, website, telephone, satellite, computer or other connections; (iv) garbled, misdirected or jumbled transitions, or traffic congestion; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from entry into or participation in the promotion (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the participant’s rights of publicity or privacy, or the participant’s claim that they have somehow been defamed or portrayed in a false light); (vi) any printing or typographical errors in any materials associated with the sweepstakes or promotion thereof, (vii) human error and other errors; or (viii) late, lost, delayed, or disrupted delivery of the prize.TO THE FULLEST EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES WILL A WINNER BE PERMITTED TO OBTAIN AWARDS FOR, AND EACH PARTICIPANT AND WINNER HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES ARISING OUT OF OR RELATED IN ANY WAY TO THE SWEEPSTAKES, THESE OFFICIAL RULES, PARTICIPANT’S ENTRY, THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES, AND THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO EACH PARTICIPANT.
PARTICIPANTS UNDERSTAND THAT EACH PARTICIPANT IS WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, PARTICIPANT ACKNOWLEDGES THAT PARTICIPANT HAS READ AND UNDERSTANDS, AND HEREBY EXPRESSLY WAIVES, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE, COUNTRY OR TERRITORY, WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”9. Use of Disclosed Information. By entering the Sweepstakes or claiming a Prize, Participant and/or winner may be sharing their personal information with Sponsor. Information transmitted to Sponsor will generally be treated as non-confidential and non-proprietary. By entering the Sweepstakes, you consent to the Sponsor sending to your e-mail address or home address promotional content or materials of the Sponsor. If you do not wish to receive these communications, you may “opt out” by following the instructions in the promotional content. Please note, however, that if you “opt-out” of receiving communications, the Sponsor may still contact Participants concerning the Sweepstakes including notifying you if you are a potential winner of a prize. By entering the Sweepstakes or claiming a prize you consent to Sponsor’s use of each winner’s name, biographical information and/or likeness for online posting and/or any other written or photographic advertising and publicity without additional compensation, except where prohibited by law.10. Reservations. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes at any time for any reason in its sole discretion, which shall be final. All Participants agree to abide by and be bound by these Official Rules. Sponsor reserves the right to permanently disqualify and/or revoke a prize from any person it believes has violated these Official Rules or has acted in a manner that is, in Sponsor’s discretion, offensive, harassing, threatening, repugnant, or violent at any time, including any tampering with the entry process. Participants further agree to not knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. All decisions of Sponsor shall be final and Participants waive any right to challenge any decisions made by Sponsor.11. Governing Law/Venue. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the Participants or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Ohio without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws, and any matters or proc
